Why Consulting an Experienced Will Writer is so Important

There’s a lot to consider when writing ones Last Will and Testament and taking advantage of the services provided by an experienced Will writing firm is paramount to ensuring your wishes are carried out.  Using one of the inexpensive Will writing kits which are available in stationary shops or filling out an online Will is likely to cause problems at a time when you’ll not be around to rectify them.

It’s of major importance to ensure the wording of your last will and testament cannot be misinterpreted, for example a statement such as, “I leave everything to my wife, and on her death it is to be shared between my children” would have been written with the best of intentions; leaving everything to his wife, however the way it has been worded actually leaves everything to the children, and the wife is merely the trustee for the inheritance and not a beneficiary.

This is a common example of how the wording of a will can have the opposite effect to what was intended.  An experienced Will writer will spot any potential wording errors such as in the above example and offer advice accordingly at the time of writing the Will. A process which is far more logical and less emotionally taxing should any wording discrepancies come to light post mortem.

The guidelines and laws surrounding writing your last will and testament are fairly straight forward, however, did you know that Scottish law on inheritance differs from English law?   Also, if you’re a UK citizen, but resident in another country, the inheritance laws and rules of succession in your country of residence may be contradictory and could cause problems when the Will is eventually read out.
